MORGANTOWN -- A Morgantown woman is suing GP-Mountaineer after she claims she was injured on its property.
Jager Management, Inc. and the Senior Monongalians Inc. were also named as defendants in the suit.
On Dec. 12, 2009, Carol Ann Miller was a business invitee at the Mountaineer Mall, which is owned by GP-Mountaineer, according to a complaint filed Nov. 29 in Monongalia Circuit Court.
Miller claims while on the defendants' property, she sustained injuries as a result of dangerous conditions on the property.
The defendants knew or should have known of the unreasonably dangerous conditions and neither corrected them, nor warned Miller of the conditions of the entrance door, sidewalk and entrance area, that were in a state of disrepair, according to the suit.
Miller claims the defendants' failure to correct the conditions or warn her constitutes negligence, which caused her to slip and fall and her resulting injuries.
The defendants' negligence caused her to suffer injuries and incur medical expenses for the injuries, according to the suit.
Miller is seeking compensatory damages with pre- and post-judgment interest. She is being represented by John R. Angotti and David J. Straface.
