* Brumfield performed a hysterectomy on Bates on Dec. 21, 2009. Bates claims during the procedure, Brumfield placed a modified bulb syringe to maintain the pneumoperitoneum. On Jan. 5, 2010, Bates attended a post-operative visit with Brumfield, where he found that the bulb syringe was still present and acknowledged it should not have been left in her body. Bates is seeking compensatory damages.

* Tickle was transferred to the care of Dr. Phillip Spangler on April 19, 2009, pursuant to a Cabell County Mental Hygiene Order. Craig claims Tickle had previously attempted to commit suicide three times prior to coming under Spangler's care. Spangler discharged Tickle on April 23, 2009, and she was found dead on May 20, 2009, having committed suicide, according to the suit. Craig is seeking compensatory and punitive damages with pre- and post-judgment interest.
