CHARLESTON -- A man is suing Beford South Point Ford after he claims he was assaulted.
In December 2009, Rodney D. Jones received material in the mail from the defendant that invited him to its St. Albans location, according to a complaint filed Dec. 9 in Kanawha Circuit Court.
Jones claims the material included an ignition key that he was to bring to the premises and if the key opened a lock box with a certain number inside, he would win a new car.
On Dec. 10, 2009, Jones went to the St. Albans store to claim his prize, but when he arrived he determined the defendant did not intend to award prizes and that the material mailed to him was designed to generate traffic at the car lot, according to the suit.
Jones claims when he expressed frustration over the fraudulent representations in the material, he was asked to leave the premises.
When he attempted to leave, Jones was then physically restrained and injured, according to the suit.
Jones claims during his efforts to escape the defendant's restraint, he was swung around such that his right knee struck a railing in front of the door to the defendant's offices, resulting in contusions and other injuries to his knee.
The injuries Jones suffered were significant and required him to report to an emergency room the next day, according to the suit.
Jones is seeking compensatory and punitive damages. He is being represented by Dana F. Eddy.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
