Woman sues state DOT for car accident injuries

CHARLESTON -- A woman is suing the West Virginia Department of Transportation-Division of Highways for injuries she sustained in a car accident.

On Dec. 14, 2009, Angela Bennett was operating her vehicle on W.Va. 92 near Greenbrier County when Robert J. Harvey Jr., who was an employee of the defendant, was operating a Department of Transportation 2007 Mack Dump Truck on the same road, according to a complaint filed Dec. 14 in Kanawha Circuit Court.

Bennett claims while driving, Harvey crossed over the center line and struck her vehicle and injured her.

The car accident was a result of negligence of the defendant's servant, agent or employee, who failed to properly operate his vehicle left of center; failed to keep a proper lookout; and maintain control of the vehicle, according to the suit.

Bennett is seeking compensatory damages. She is being represented by Larry O. Ford.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
