Woman accuses Huntington doctor of negligence

HUNTINGTON -- A woman is suing a Huntington physician for negligence during a surgical procedure.

On Dec. 21, 2009, Dr. Steven S. Brumfield performed a hysterectomy on Barbara Bates, according to a complaint filed Dec. 21 in Cabell Circuit Court.

Bates claims during the procedure, Brumfield placed a modified bulb syringe in her vagina to maintain the pneumoperitoneum.

On Jan. 5, 2010, Bates attended a post-operative visit with Brumfield, where he found that the bulb syringe was still present and acknowledged it should not have been left in her body, according to the suit.

Bates claims Brumfield was negligent in failing to remove the bulb syringe when he concluded the surgery.

The defendant had a duty to exercise a certain degree of care, skill and learning required or expected of a reasonable, prudent physician acting in the same or similar circumstances and failed to do so, according to the suit.

Bates is seeking compensatory damages. She is being represented by Amy C. Crossan.

The case has been assigned to Circuit Judge F. Jane Hustead.
