Woman sues over injuries at gas station

WAYNE -- A woman is suing Benjamin Custom Buildings for injuries she sustained at a Shell gas station.

D&R, LLC; Par Mar License Holding Company; and Federal Heath Sign Company, LLC were also named as defendants in the suit.

On July 15, 2010, Jennifer Price was a customer of a Shell gas station in Wayne County, according to a complaint filed Dec. 21 in Wayne Circuit Court.

Price claims when she stepped out of her vehicle at the gas pump, she unknowingly stepped onto an exposed anchor bolt that was negligently left during a reimaging project at the gas station.

The defendants' negligence caused Price to sustain a severe personal injury to her right foot, according to the suit.

Price claims the defendants failed to provide safe and suitable premises.

The defendants failed to inspect the premises for hazards or unsafe conditions and to correct the hazards or unsafe conditions likely to cause harm to customers and/or business invitees, according to the suit.

Price is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Christina L. Smith and Robert V. Berthold Jr.

The case has been assigned to Circuit Judge Darrell Pratt.
