CHARLESTON -- A St. Albans woman is suing Aldi after an employee struck her leg with a motorized stocking machine.
On Nov. 9, 2010, Glenna Arthur was shopping at Aldi in Dunbar when an employee struck her in the leg with a motorized stocking machine, pushing her into the coolers and causing her to sustain injuries to her left leg and other areas of her body, according to a complaint filed Dec. 19 in Kanawha Circuit Court.
Arthur claims the defendant is responsible for the actions and omissions of its employees while int he scope of their employment.
The defendant's employee was negligent, reckless and careless when when he ran into Arthur with the stocking machine, according to the suit.
Arthur claims the defendant was also negligent in requiring its employees to operate dangerous machinery while customers are shopping.
The defendant knew or should have known that allowing its employees to operate a motorized stocking machine while customers are shopping in Aldi is a dangerous activity and should have foreseen the conditions would be a hazard and a danger to the patrons, according to the suit.
Arthur is seeking compensatory damages. She is being represented by Michelle L. Johnson.
The case has been assigned to Circuit Judge Charles E. King.
