Couple says defective bus seat caused injuries

CHARLESTON -- A Kanawha County couple is suing Advantage Coach Limited Liability Company for a defective seat on a tour bus that caused injuries.

On May 5, 2010, Doug Stephens was a passenger on an Advantage tour bus from Cincinnati, Ohio, to Charleston, according to a complaint filed Dec. 20 in Kanawha Circuit Court.

Stephens claims when he attempted to exit his seat to use the restroom, the seat jolted up and injured him.

The seat on the bus was not securely bolted to the floor, according to the suit.

Stephens claims as a result of the seat not being securely bolted to the floor, he incurred both physical and mental injuries.

The defendant had a duty to properly inspect, maintain and repair any defects with regard to its seats, according to the suit.

Stephens and his wife, Erin Stephens, are seeking compensatory damages. They are being represented by Michael J. Del Giudice and Keisha D. May.
