* John Renner is seeking compensatory and punitive damages for wrongful termination of his job as mine forman for the Federal No. 2 mine. Renner claims that during his employment, he was instructed to manipulate gas readings for seals by flooding the seals with nitrogen 15 minutes prior to taking a reading. On one occasion, Renner obtained a bad gas reading of a seal, which resulted in his evacuating the mine. He was threatened with the loss of his job if he shut the mine down again. He was terminated for what the defendants say were mandatory health and safety regulations and falsifying records regarding those violations. Renner alleges he was fired in retaliation for whistle blowing activities. He also seeks lost wages and benefits, loss of earning capacity damages, back and front pay, reinstatement of employment, fringe benefits and senority rights, costs and attorney fees.
