* In 2009, as a result of estate planning, Joe Fazio and Nell Fazio had wills prepared and created inter vivos trusts designated as the Joe Fazio Revocable Trust-2009 and the Nell J. Fazio Revocable Trust-2009. Joe Fazio claims shortly after Nell Fazio's death, Danny Fazio began pressuring his father to give him control of the restaurant business. Joe Fazio claims Danny Fazio gave him papers to sign that he was led to believe dealt with Nell Fazio's estate, but later discovered they were papers signing over his 6,000 shares of stock to Danny Fazio. Joe Fazio is seeking compensatory and punitive damages with pre- and post-judgment interest.

* On June 1, 2011, Jerrell was the driver of a 2008 Ford Explorer traveling north on W.Va. Route 16 in Hilltop. Anderson claims Jerrell negligently operated her vehicle and caused it to crash head-on into the car Thomas was driving. Jerrell had been a patron at The Cold Spot before the accident and had negligently sold and provided Jerrell with a quantity of alcohol that caused her to be inebriated, according to the suit. The vehicle accident caused the death of Thomas, according to the suit. Anderson is seeking compensatory and punitive damages.
