CHARLESTON -- A Belle couple is suing Thrasher Engineering after they claim the company caused them property damages.
Malden Public Service District was also named as a defendant in the suit.
In March 2010, Thrasher commenced construction and repair work on equipment and property owned by Malden and adjacent to the Montgomery residence, according to a complaint filed Jan. 6 in Kanawha Circuit Court.
Alfred Montgomery and Angel Montgomery claim the construction work was performed in a negligent manner and not according to construction and engineering standards.
The defendants' wrongful conduct, fallout has routinely settled on the Montgomery property, including on their home and their vehicle, according to the suit.
The Montgomerys claim in May 2010 they began experiencing cracks in their walls, floors, ceilings and foundation of their home, as well as the smell of a strong odor of sewage.
The defendants have caused the Montgomerys property damages, inconvenience and distress, according to the suit.
The Mongomerys are seeking compensatory and punitive damages. They are being represented by G. Patrick Jacobs.
The case has been assigned to Circuit Judge Tod J. Kaufman.
