Marmet couple sues contractor, city, water company for outages

CHARLESTON -- A Marmet couple is suing Mike Enyart & Sons for water outages.

West Virginia American Water and the City of Marmet were also named as defendants in the suit.

In February and/or March 2010 Enyart engaged in busting and removing the asphalt roadway on 87th Street in Marmet near the property of William Reese and JoAnn Reese and were in the process of removing old pipeline and/or installing new pipeline, according to a complaint filed Jan. 17 in Kanawha Circuit Court.

The Reeses claim they began to experience water outages due to Enyart's negligent construction and engineering methods.

West Virginia American Water came on or near the Reese property and negligently increased the pressure in the water lines going into the Reese property, which then ruptured the pressure regulator under the house and then caused a build-up of excessive pressure in the hot water tank and caused the water tank to overflow and damage the surrounding floor, according to the suit.

The Reeses are seeking compensatory damages with pre- and post-judgment interest. They are being represented by G. Patrick Jacobs.

THe case has been assigned to Circuit Judge Carrie Webster.
