Mother sues woman who struck her child with vehicle

HUNTINGTON -- A mother is suing a woman she claims struck her son with a vehicle while he was attempting to cross the street on a bicycle.

On May 22, 2011, Jarrod Varney was a bicyclist lawfully attempting to cross the street in the 1900 block of Charleston Avenue when Dorothy Brown, who was driving a 2007 Chevrolet Cobalt sedan struck him with her vehicle and caused him injury, according to a complaint filed Jan. 31 in Cabell Circuit Court.

Wendi Whitmore claims after striking her son with her vehicle, Brown left the scene, where Varney was left unconscious in the middle of Charleston Avenue.

Brown returned to the scene traveling southbound on 19th Street and crossed Charleston Avenue, where she then came to a stop, according to the suit.

Whitmore claims since the incident, her son has been experiencing headaches, sleep deprivation, associated nausea, occasional tinnitus and new onset somniloquy. She claims he is still receiving treatment, follow-up care and monitoring for his injuries and associated symptoms sustained as a result of the accident.

Brown failed to maintain proper control of her vehicle and is responsible for Varney's injuries, according to the suit.

Whitmore is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Mark F. Underwood and Jessica Y. Whitmore.

The case has been assigned to Circuit Judge David M. Pancake.
