HUNTINGTON -- A man is suing Kia Motors America, Inc., after he claims the vehicle he purchased was defective.
On July 30, 2009, Ralph Barcus purchased a 2009 Kia Spectra EX from the defendant, according to a complaint filed Feb. 1 in Cabell Circuit Court.
Barcus claims the vehicle has continued to not conform to its applicable express warranties and the safety and market value of the vehicle remain substantially impaired.
Kia Motors America has failed to conform the vehicle to its warranties, according to the suit.
Barcus is seeking revocation of acceptance and refund of the purchase price of the vehicle; repair costs; and damages for annoyance and inconvenience. He is being represented by W. Michael Frazier.
The case has been assigned to Circuit Judge David M. Pancake
