Woman beaten, robbed at Charleston Town Center sues mall for attack

CHARLESTON -- A woman who was beaten and robbed in Charleston Town Center's parking garage is suing the mall after she claims a security guard admitted to noticing two men loitering prior to the attack on her.

Charleston Town Center Parking Limited Partnership; Charleston Town Center Garage, Inc.; Networking Parking Company, Ltd.; Network Parking, LLC; U.S. Security Associates, Inc.; Jordan Fletcher; and Brandon Wood were also named as defendants in the suit.

On April 25, 2011, Debbie Page was shopping at Macy's Department Store in the Charleston Town Center and was exiting through the parking garage exit on the third floor when she was severely beaten and robbed by Fletcher and Wood, according to a complaint filed Feb. 7 in Kanawha Circuit Court.

Page claims help did not arrive until another shopper allowed her to use her cell phone to call 911.

Once Charleston police arrived at the scene, a mall security guard admitted that immediately prior to the assault, he had observed Wood and Fletcher loitering in the parking garage, recognized that they posed a threat to shoppers, but did nothing to remove them from the mall premises, according to the suit.

Page claims the assault was allowed to occur because the defendants ignored their duties to provide reasonable security to mall invitees like her.

The defendants also failed to deploy adequate security measures despite luring countless patrons into the mall by marketing the Charleston Town Center Parking Garage as a safe and convenient premises, according to the suit.

Page is seeking compensatory damages. She is being represented by Eric B. Snyder and Robert P. Lorea.

The case has been assigned to Circuit Judge Carrie Webster.
