MORGANTOWN -- A Nicholas County couple is suing DJM Builders after injuries were sustained from a construction project.
SonCo Worldwide, Inc. and Cleveland E. Yost Jr. were also named as defendants in the suit.
On Nov. 13, 2010, Yolinda Stull was walking in close proximity to the fencing surrounding the site where construction activities were being performed, when she tripped and fell over the protruding supports of the fencing, which caused her to fall and being seriously injured, according to a complaint filed Feb. 3 in Monongalia Circuit Court.
Stull claims the defendants breached their duties of care by failing to erect signs or advise or warn the public that the sidewalk and walkway where pedestrians would have walked in order to travel around the construction site.
As a result of the defendants' negligence, Stull was required to undergo surgery to partially replace her hip, according to the suit.
Stull claims she has incurred medical bills and expenses in an amount in excess of $53,000 and will continue to incur medical bills and expenses in the future for treatment resulting from the injuries.
The defendants caused Stull to endure substantial and permanent pain, suffering and mental anguish due to their negligence, according to the suit.
Stull and her husband, Daniel Stull, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Gregory W. Sproles.
