HUNTINGTON -- An Ohio woman is suing Dave Flowers, Inc., for injuries she sustained from a shooting.
John Davis Flowers was also named as a defendant in the suit.
On Feb. 20, 2010, Kaitlin Grace Marcum was allowed on the Venom Club's premises even though she was not over the age of 21, according to a complaint filed Feb. 17 in Cabell Circuit Court.
Marcum claims while in the club someone was permitted to enter the premises with a firearm in his possession.
The individual with the firearm discharged it when in doing so, struck Marcum in her mid-right thigh by fragments of a bullet, according to the suit.
Marcum claims the defendants caused her to suffer injuries, including pain and suffering; scaring; mental distress; anguish; and annoyance and inconvenience.
The defendants were negligent in failing to ensure that the premises were safe and breached their duty to Marcum by allowing a person to enter the premises with a firearm, according to the suit.
Marcum is seeking compensatory damages. She is being represented by Dana F. Eddy.
The case has been assigned to Circuit Judge David M. Pancake.
