CHARLESTON -- A Sidney, Ky., man and his daughter are suing a Charleston restaurant after he sustained injuries on its premises.
Charleston Lube Partners, the primary defendant, is doing business as Quaker Steak and Lube. Charleston WV-QSL, LLC; Ridge Line, Inc.; and an unknown woman were also named as defendants in the suit.
On April 20, 2011, Edgar Barry Reed and his daughter, Savannah Reed, entered the Quaker Steak and Lube for the purpose of eating lunch, according to a complaint filed Feb. 9 in Kanawha Circuit Court.
Edgar Reed claims when he attempted the leave the restaurant, he fell into an uncovered recession and was injured.
The defendants failed to keep the recession covered during normal business hours or to place reasonable and proper barriers and warnings around the recession when the plexiglass was removed, according to the suit.
Edgar Reed and Savannah Reed claim the defendants' negligence caused him to incur medical expenses in excess of $10,000.
The defendants also knew or should have known of the latent hazards the recession created, according to the suit.
Edgar Reed and Savannah Reed are seeking compensatory damages. They are being represented by Christian R. Harris and Howard M. Persinger III.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
