* On Feb. 24, 2010, Neal was discharged from the hospital. He claims when he arrived home he picked up a coffee cup and felt a "sharp sensation like sticking with a needle" in his left forearm. The following day he claims he contacted the defendant and was told to remain at home rather than "going to the ER and sitting for hours." On Feb. 26, 2010, he went to Charleston Area Medical Center and obtained an x-ray where it was discovered that there was something in his arm, according to the suit. Neal claims a surgeon removed the foreign body later that day. Neal is seeking compensatory damages with pre- and post-judgment interest.
