CHARLESTON -- A woman is suing Cedar Ridge Center after she claims it is responsible for her mother's death.
Genesis Healthcare, LLC was also named as a defendant in the suit.
On March 3, 2010, Betty Jean Claypoole was admitted to Cedar Ridge Center to provide her with quality care, according to a complaint filed Feb. 24 in Kanawha Circuit Court.
Vicky Garrett, Claypoole's daughter, claims during her admission to Cedar Ridge Center, Claypoole suffered serious injuries from a pattern of poor care, neglect and abuse rendered by Cedar Ridge Center.
The defendants' negligence caused the significant destruction of Claypoole's physical and mental condition during her residency, according to the suit.
Garrett claims the defendants "failed to recognize the potential adverse effects of administering insulin to a resident refusing to eat meals/snacks and to administer insulin in a safe and appropriate manner."
The defendants also failed to provide the necessary amount of fluid to Claypoole so as to prevent dehydration, according to the suit.
Garret claims the defendants' actions caused her mother's death.
The defendants breached their duties to Claypoole and caused the significant injuries that ultimately led or contributed to her death on May 17, 2010, according to the suit.
Garrett is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart.
The case has been assigned to Circuit Judge Carrie Webster.
