Supplier sues JB Energy for failure to pay more than $75,000

CHARLESTON -- James River Equipment, Virginia, LLC is suing JB Energy, LLC after it claims the company has failed to pay for more than $75,000 in goods and services.

William J. Bostic was also named as a defendant in the suit.

On June 5, 2009, the defendants executed a credit application with James River in order to establish a credit line to purchase parts, service and equipment, according to a complaint filed Feb. 23 in Kanawha Circuit Court.

James River claims the defendants incurred a substantial outstanding account balance in the amount of $76,063.21 and has failed and refused to make payment.

Despite notifying the defendants that they were in default on the account and were incurring interest and collection costs, the defendants breached their contract with James River by failing and refusing to make payment, according to the suit.

James River claims the defendants failed to pay all sums due and owing for equipment, parts and services.

The defendants have caused James River to incur damages in the amount of at least $66,373.55, according to the suit.

James River is seeking judgment in the amount of at least $66,373.55, plus continuing pre-judgment interest at the rate of 1.5 percent per month and post-judgment interest. It is being represented by Jason S. Hammond.

The case has been assigned to Circuit Judge Charles E. King.
