Raleigh Co. couple sues Integrated Healthcare Providers, physician for injuries

CHARLESTON -- A Raleigh County couple is suing Integrated Healthcare Providers for injuries sustained during surgery.

Dr. Julio Davalos was also named as a defendant in the suit.

On Oct. 13, 2009, Davalos performed a surgical procedure on Elmer Price, according to a complaint filed Feb. 24 in Kanawha Circuit Court.

Price claims Davalos failed to monitor all aspects of the organs surrounding the prostate and caused damage to those organs during the procedure.

The defendants' failure to monitor the surrounding organs during surgery was negligent and resulted in Davalos causing damage to the prostate and surrounding organs, including Price's bladder, according to the suit.

Price claims the defendants' negligence resulted in incontinence and impaired bowel function.

The defendants' negligence also caused Price great and irrevocable loss, according to the suit.

Price and his wife, Diane Price, are seeking compensatory damages with pre-judgment interest. They are being represented by Edward G. Atkins.

The case has been assigned to Circuit Judge Tod J. Kaufman.
