CHARLESTON -- A Charleston couple says that NCO Financial Systems harassed them about an alleged debt by calling them more than 50 times.
Since March 22, 2011, NCO has contacted Robert Davis and Kay Davis more than 50 times by telephone in an attempt to collect an alleged debt, according to a complaint filed March 7 in Kanawha Circuit Court.
The couple claims the defendant's attempts were done so after they demanded the defendant to stop calling them and notified them that they did not owe the alleged debt.
The timing, manner and excessive number of phone calls made by the defendant to the plaintiffs constitutes conduct the natural consequence of which is to "harass, oppress or abuse the plaintiffs," according to the suit.
The Davises claim the defendant's actions were willful, wanton or reckless and in total disregard for their civil rights.
NCO's conduct also caused the Davises to suffer damages, including aggravation and embarrassment, according to the suit.
The couple is seeking compensatory and punitive damages. They are being represented by Thomas H. Peyton.
The case has been assigned to Circuit Judge Charles E. King.
