HUNTINGTON -- A woman is suing Seventeenth Street Associates for negligence in caring for her family member during her residency.
Seventeenth Street Associates is doing business as Huntington Health and Rehabilitation Center.
Starlett Thompson was a nursing home resident of the defendant's on three separate occasions from Oct. 17, 2008, until June 22, 2011, according to a complaint filed March 19 in Cabell Circuit Court.
Barbara Mannon claims the defendant failed to implement appropriate fall prevention measures, provide adequate supervision and develop, implement and revise a care plan for the prevention of falls.
During her residencies, the defendant failed to notify the physician of blood in Thompson's urine, stool and diaper on multiple occasions, according to the suit, and as a result, there was a delay in transferring Thompson to the hospital where she was diagnosed as having rectal cancer and a delay in receiving treatment.
Mannon claims the defendant's negligence and carelessness caused Thompson pain, suffering and a decline in her overall status.
As a result of the defendant's negligence, Thompson sustained bodily injuries, resulting in pain and suffering, mental anguish, inconvenience, physical impairment, loss of capacity for the enjoyment of life, aggravation of existing diseases and physical defects and incurred medical expenses, according to the suit.
Mannon is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart.
The case has been assigned to Circuit Judge David M. Pancake.
