CHARLESTON -- A Kanawha County woman is suing the Charleston Marriott for injuries she sustained on its property due to a slightly elevated floor.
Forest City Enterprises was also named a a defendant in the suit.
On April 1, 2010, Vickie Miller was on the defendants' premises and was walking in an area on the ground floor when she fell as a result of coming into contact with an area of the floor that was slightly elevated, but not sufficiently visible as to be reasonably avoided, according to a complaint filed March 22 in Kanawha Circuit Court.
Miller claims the area of the floor that was negligently constructed and maintained by the defendants was not marked or otherwise indicated so as to reasonably avoid the harm to which she suffered.
The defendants' failure to safely construct, maintain or provide measures as to prevent injury to customers was negligent and caused Miller to suffer a broken knee and other physical injuries, according to the suit.
Miller is seeking compensatory damages. She is being represented by Mark McMillian.
The case has been assigned to Circuit Judge Charles E. King.
