Oak Hill woman sues St. Francis for injuries

CHARLESTON -- An Oak Hill woman is suing St. Francis Hospital for injuries she sustained while exiting the hospital.

On Aug. 18, 2010, Madeline Betty Hamilton was a patient of the hospital and was exiting a rear door of the hospital on her way to the pain clinic when she slipped and fell on sloping, uneven pavement and was injured, according to a complaint filed March 9 in Kanawha Circuit Court.

Hamilton claims the defendant had actual or constructive notice that the sloping sidewalk created a dangerous condition.

The defendant did not take any steps reasonably calculated to remove the condition, according to the suit.

Hamilton claims the defendant also failed to place guardrails or warning signs.

St. Francis Hospital had a duty to maintain its business premises in a reasonably safe condition and failed to do so, according to the suit.

Hamilton is seeking compensatory damages. She is being represented by Philip J. Tissue.

The case has been assigned to Circuit Judge Jennifer Bailey.
