MORGANTOWN -- Two siblings are suing Evergreen of Morgantown for negligently caring for their mother while she was in the nursing home's care.
Personal Care at Evergreen, Inc.; Assisted Living at Evergreen, Inc.; Marcy Hile; John Does 1 through 10; and Unidentified Entities 2 through 10 (as to Evergreen of Morgantown) were also named as defendants in the suit.
On July 22, 2009, Edna Liston was admitted to Evergreen of Morgantown, where she remained until March 31, 2011, according to a complaint filed March 9 in Monongalia Circuit Court.
Gary Liston and Carol Glover claim their mother suffered catastrophic injuries, disfigurement, extreme pain, suffering and mental anguish while in the defendants' care.
The scope and severity of the recurrent wrongs inflicted upon Edna Liston while under the care of the defendants accelerated the deterioration of her health and physical condition beyond that caused by the normal aging process and resulted in physical and emotional trauma, including falls, fractures and death, according to the suit.
The plaintiffs claim the defendants were negligent in their care of their mother and are responsible for her death.
Gary Liston and Glover are seeking compensatory and punitive damages. They are being represented by James B. McHugh and Michael J. Fuller Jr.
