WINFIELD -- A former employee is suing Trinity Coal Corporation for failing to pay his final employment wages within 72 hours of terminating his employment.
Adam W. Tincher was employed by the defendant from October 2011 until Jan. 4, according to a complaint filed March 19 in Putnam Circuit Court.
Tincher claims the defendant failed to pay him his final wages within 72 hours of discharge and instead, did not pay his final wages until Jan. 13.
The defendant's failure to pay Tincher's final wages with 72 hours of discharge violated the West Virginia Wage Payment and Collection Act, according to the suit.
Tincher is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
