Jackson Co. man sues The Cold Spot for injuries

CHARLESTON -- A Jackson County man is suing The Cold Spot after a drunk driver struck his vehicle.

Hilda Jerrell, a patron of The Cold Spot, was also named as a defendant in the suit.

On June 1, 2011, Jerrell was the driver of a 2008 Ford Explorer traveling north on W.Va. 16 in Fayette County when she recklessly operated her vehicle and caused it to crash head on into the vehicle in which Robert O'Connell and Christian O'Connell were passengers, according to a complaint filed March 26 in Kanawha Circuit Court.

Robert O'Connell claims The Cold Spot provided Jerrell with alcohol prior to the accident.

The Cold Spot negligently, unlawfully and recklessly sold and provided Jerrell with a quantity of alcohol and knew or should have known that she would leave the bar and, due to her inebriated state, negligently, unlawfully and recklessly operate her vehicle, according to the suit.

Robert O'Connell and Christian O'Connell are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Paul M. Stroebel.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
