Wayne Co. couple sues Chili's for injuries

HUNTINGTON -- A Kenova couple is suing Chili's of West Virginia for injuries sustained at its restaurant.

On Nov. 26, 2010, Kristen White Parsons was at the defendant's restaurant when she slipped on a substance on the floor and fell, according to a complaint filed March 28 in Cabell Circuit Court.

Parsons claims the defendant had a duty of care to keep the premises in a reasonably safe condition and failed to do so.

The defendant breached its duty by failing to properly provide and maintain adequate lighting; failing to keep the passageway intended for public use free and clear from unreasonable defects, hazards or obstructions; failing to construct and arrange its aisles and displays to keep them free and clear from defects; failing to exercise reasonable care; and by failing to warn Parsons of the existence of the conditions, according to the suit.

Parsons claims the defendant was negligent in causing her injuries.

Parsons and her husband, Joshua Parsons, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Paul E. Biser.

The case has been assigned to Circuit Judge F. Jane Hustead.
