CHARLESTON -- Two former clinical nurses are suing Charleston Area Medical Center after they claim they were retaliated against and unlawfully terminated from their employment.
Sheila K. Farris began her employment with the defendant in 1985 as a Clinical Nurse-II and worked at the defendant's Surgicare Center, according to her complaint filed April 3 in Kanawha Circuit Court.
Pamela G. Dawson began her employment with the defendant in January 1986 as a Clinical Nurse-III and worked at the defendant's Surgicare Center, according to her complaint filed April 3.
On Sept. 28, 2011, Farris and Dawson both claim they reported to supervisors that a patient's health information was not being kept private and confidential, and was being disclosed in violation of the Health Insurance Portability and Accountability Act of 1996.
On Oct. 4, 2011, the defendant willfully, maliciously and unlawfully terminated the employment of Farris and Dawson, according to the suits.
Farris and Dawson claim as a result of the defendant's actions, they has suffered lost wages and benefits.
CAMC caused Farris and Dawson to suffer severe emotional and mental distress, humiliation, anxiety, embarrassment, aggravation, annoyance and inconvenience, according to the suit.
Both Farris and Dawson are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Todd S. Bailess and Joy B. Mega.
