HUNTINGTON -- A Cabell County couple is suing the Huntington Sanitary Board for damages sustained to their property because of a sewer line installed behind their home.
As part of the Inwood sewer project, the Huntington Sanitary Board installed a sewer line behind the home owned by Larry Caserta and Katrina Caserta and the line was installed in the crest of the hill and transversed the backside of their property, according to a complaint filed April 6 in Cabell Circuit Court.
On April 1, 2011, the Casertas claim their entire back yard gave way and the yard and hillside collapsed.
The collapse occurred right at the area where the city sewer line transversed the Casertas property, according to the suit.
The Casertas claim during the repair of the collapse, it was determined that the defendant's installation of the city sewer line damaged the storm drain line installed to take the roof water off of their home and down to the bottom of the hill.
As a result of this damage, when the rains would ensue, the damaged line would dump water into the defendant's ewer line ditch, according to the suit.
The Casertas claim they were forced to hire a contractor to repair the entire back part of their yard and hillside.
The defendant's actions were willful, wanton, intentional, malicious and reckless, according to the suit.
The Casertas are seeking compensatory and punitive damages. They are being represented by R.R. Fredeking II.
The case has been assigned to Circuit Judge David M. Pancake.
