Man says clock fell on his head at Elder-Beerman

CHARLESTON -- A Charleston man is suing Bon-Ton Department Stores after a clock fell on his head.

On April 10, 2010, Hassan M. Ghannam was at Elder-Beerman in Charleston when a clock on a shelf fell and struck him on the head, according to a complaint filed April 10 in Kanawha Circuit Court.

Ghannam claims the defendant had a duty and responsibility of maintaining its building and contents in good repair and failed to do so.

Due to the defendant's negligence and carelessness in maintaining its store, Elder-Beerman had improperly displayed clocks on shelving units causing a clock to fall from the top shelf and injure Ghannam, according to the suit.

Ghannan is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Stephen L. Gaylock.

The case has been assigned to Circuit Judge Charles E. King.
