CHARLESTON -- A former employee is suing the Pittsburgh Institute of Aeronautics after she claims it failed to pay her final wages in a timely manner.
Deborah Bagby worked for the defendant from January 2002 until her discharge on Feb. 15, according to a complaint filed April 18 in Kanawha Circuit Court.
Bagby claims the defendant failed to pay her final wages within 72 hours of discharging her from her employment.
The defendant did not provide Bagby with her final wages until Feb. 23, according to the suit.
Bagby claims the defendant's actions violated the West Virginia Wage Payment and Collection Act.
The defendant's actions also entitle Bagby to treble damages, according to the suit.
Bagby is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge James C. Stucky.
