Huntington man sues Setzer's for defective motor home

HUNTINGTON -- A Huntington man is suing Setzer's World of Camping for a motor home he purchased that he claims was defective.

On Sept. 16, 2007, James G. Dalton purchased a new 2007 Fleetwood Bounder motor home from the defendant, according to a complaint filed April 23 in Cabell Circuit Court.

Dalton claims within the first 60 days of owning to motor home and prior to the expiration of the express warranty, he returned the motor home because it was not starting, a problem he believed to be electrical in nature.

Subsequently, following the purchase of the motor home and prior to the expiration of the express warranty, Dalton returned the motor home for other additional repairs because of various other electrical problems associated with the operation of the motor home and its features, including the speakers, refrigerator, ice maker, air conditioner and water heater, according to the suit.

Dalton claims the defendant failed to correct the motor home's non-conformities, despite him returning the motor home on at least three occasions for repairs.

The defendant's actions in concealing the defects and failing to inform Dalton of the problems were fraudulent, according to the suit.

Dalton is seeking compensatory damages with pre-judgment interest. He is being represented by Robert B. Kuenzel.

The case has been assigned to Circuit Judge David M. Pancake.
