CHARLESTON -- A man is suing the City of St. Albans after he claims he sustained injuries due to the city's sewer grates.
The St. Albans Municipal Utility Commission was also named as a defendant in the suit.
On April 23, 2010, David Michael Eaton Jr. was exiting his vehicle when he stepped into a hole beside a great, which caused him the suffer injuries to his lower back and lower left leg, according to a complaint filed April 19 in Kanawha Circuit Court.
Eaton claims the defendants caused or allowed the dangerous condition to exist in the streets and knew or should have known the condition created a substantial risk of injury.
The defendants failed to take reasonable cautions to prevent injury resulting from the existence of the dangerous condition and further failed to warn the public, according to the suit.
Eaton is seeking compensatory damages in the amount of $50,000 with pre-judgment interest. He is being represented by Stephen P. Swisher.
The case has been assigned to Circuit Judge Charles E. King.
