Princeton woman sues Con-way Freight for nephew's death

CHARLESTON -- A Princeton woman is suing Con-way Freight for the death of her 18-year-old nephew.

Harvey Leist, an employee of Con-way Freight and Gregory W. Price were also named as defendants in the suit.

On Nov. 17, 2011, Price was driving a 2001 Toyota Celica eastbound on U.S. 460 near milepost 26 near Kellysville with Rhett Harvey as a passenger in the Celica, according to a complaint filed May 1 in Kanawha Circuit Court.

Laura Delp claims Leist was operating a 2006 Sterling tractor with two trailers and had parked the vehicle along the eastbound road edge of U.S. 460 when Price collided the Celica with the tractor-trailer, which ultimately caused Harvey's death.

Con-way Freight owned, leased, rented, operated and/or utilized the tractor trailer, according to the suit.

Delp claims Con-way and Leist were negligent in operating the tractor-trailer.

The defendants' negligent acts and/or omissions caused or contributed to Harvey's injuries and death, according to the suit.

Delp is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Christopher J. Heavens.

The case has been assigned to Circuit Judge Jennifer Bailey.
