Woman sues Probill for wage payment violations

HUNTINGTON -- A former employee is suing Whitaker Physician Billing Services Inc. after she claims the company violated the West Virginia Wage Payment and Collection Act.

Whitaker is doing business as Probill Inc.

Christie Marie Prince was employed by the defendant from April 13, 2008, until April 16, according to a complaint filed May 4 in Cabell Circuit Court.

Prince claims the defendant failed to pay her final wages within 72 hours of terminating her employment.

The defendant's actions violated the West Virginia Wage Payment and Collection Act, according to the suit.

Prince claims the defendant's failure to pay her final wages in a timely manner entitles her to liquidated damages.

The defendant's actions were also "contrary to the principles of freedom and equality of opportunity, and is destructive to a free and democratic society," according to the suit.

Prince is seeking compensatory and liquidated damages. She is being represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III.

The case has been assigned to Circuit Judge David M. Pancake.
