HUNTINGTON -- A man is suing his former employer after he claims the man attacked him, terminated his employment and failed to pay his final wages.
On Nov. 8, 2011, Ronald Kristopher Hibner, who was employed as a construction laborer by Jason Carson, was performing his job duties when he and Carson became engaged in a verbal argument that Carson then escalated to a physical altercation, according to a complaint filed May 16 in Cabell Circuit Court.
Hibner claims Carson violently attacked him from behind, knocking him to the ground, striking him repeatedly and causing injuries to his face, nose, cervical spine, upper back and lower left leg.
In addition to Hibner's physical injuries, Carson also terminated Hibner's employment, according to the suit.
Hibner claims he has still not been paid the wages accrued while working for Carson prior to suffering the assault and battery and termination of his employment.
Carson's actions in failing to pay Hibner his wages, violated the West Virginia Wage Payment and Collection Act, according to the suit.
Hibner is seeking compensatory damages. He is being represented by Edwin H. Pancake.
The case has been assigned to Circuit Judge David M. Pancake.
