Ron Curry vs. Jan-Care Ambulance Service – Tri-State Division Inc. and Jan-Care Ambulance, Inc.

* Curry was employed by Jan-Care as an emergency medical technician from Marcy 2009 until Sept. 20, 2011. Curry claims he took leave in May 2011 under the Family Medical Leave Act, providing explicit notice to Jan-Care that he suffered from disabilities. Curry claims in August 2011 his treating physician gave notice to Jan-Care that Curry would be able to return to work on Sept. 20, 2011. The defendants did not inform Curry that it would not accommodate his disability and terminated his employment. Curry is seeking compensatory and punitive damages with pre- and post-judgment interest.

* On Dec. 19, 2011, Carr notified the defendants he disputed an alleged debt, was represented by counsel and provided the defendants with his counsel's name and address. He claims the defendants continued to attempt to collect the alleged debt from him and called him on at least 35 occasions between Dec. 19, 2011 and February. Carr is seeking civil penalties in the amount of $4,600 for each of the defendants' violations of West Virginia code and punitive damages.

* On May 28, 2010, Marcia Morgan presented to Honrado with symptoms and complaints that required medical investigation, diagnosis and referral to a surgeon for appropriate treatment. Steven Morgan claims the defendants failed to accurately diagnose Marcia Morgan and discharged her from the emergency department. Marcia Morgan died on July 28, 2010 after suffering gangrenous bowel and significant complications, which resulted in bilateral above-knee amputations and extreme pain and suffering. Steven Morgan is seeking compensatory damages.
