Former employee says Logan Corporation violated wage payment act

CHARLESTON -- A former employee is suing Logan Corporation after he claims it failed to pay his final wages within 72 hours of discharging him from his employment.

Herbert F. Harris was employed by the defendant from September 2010 until March 13, according to a complaint filed May 25 in Kanawha Circuit Court.

Harris claims he did not receive his final wages until March 30.

The defendant's failure to pay Harris' final wages within 72 hours of discharge violated the West Virginia Wage Payment and Collection Act, according to the suit.

Harris claims the defendant's actions entitle him to treble damages.

The defendant's actions also caused Harris embarrassment, humiliation and emotional distress, according to the suit.

Harris is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.

The case has been assigned to Circuit Judge Charles E. King.
