Court reporting firm sues Kanawha woman over defective vehicle

CHARLESTON -- Johnny Jackson & Associates is suing a Kanawha County woman for a defective vehicle purchased from her.

In April, Donna J. Turner advertised the sale of a 2001 Audi a4, which was described in the advertisement to be a very nice vehicle and in good running order, according to a complaint filed May 24 in Kanawha Circuit Court by Johnny Jackson & Associates.

Johnny Jackson claims he contacted Turner in response to the advertisement and met with Turner regarding the vehicle.

Turner represented and warranted to Jackson that she had purchased the vehicle in November 2011 and had been driving the vehicle without experiencing problems, according to the suit.

Jackson claims Turner stated the vehicle was in good working order, but it needed a turbo installed, which was located in the trunk of the vehicle.

On April 26, Jackson took possession of the vehicle and paid Turner $4,800 for the purchase price, according to the suit.

Jackson claims within four days of purchasing the vehicle, the engine suddenly quit, so he took the vehicle to at least two mechanics, who reported the vehicle had a serious oil pressure problem and other defects and that the problems should have been known to the prior owner at the time of the sale.

The cost to repair the vehicle exceeds the purchase price, deeming the vehicle to be of no use to Jackson, according to the suit.

Jackson claims Turner's representations were false and that she had, in fact, purchased the vehicle approximately three weeks before she sold it to Jackson and she was aware of the problems with the vehicle.

Turner failed and refused to respond to Jackson's attempts to contact her regarding the vehicle, according to the suit.

Jackson is seeking compensatory damages with pre-judgment interest. The plaintiff is being represented by Ted M. Kanner.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
