CHARLESTON -- A Lincoln County woman is suing her obstetrician after she claims he failed to perform a tubal ligation procedure on her during the Caesarean delivery of her child.
Randall J. Hill, M.D., PLLC was also named as a defendant in the suit.
In October 2009, Lisa D. Saddler became an obstetric patient of Dr. Randall J. Hill and his practice, according to a complaint filed May 23 in Kanawha Circuit Court.
Saddler claims at the time of her pregnancy, she received a West Virginia Medicaid card for all pregnancy-related medical issues and beginning at approximately her second office visit, she informed the defendants that she desired to have a tubal ligation at the time of her delivery and she was scheduled for a Caesarean delivery and tubal ligation on June 2, 2010.
On May 23, 2010, Saddler went into labor and was informed on her way to delivery in the early hours of May 24, 2010, that the tubal ligation would not be completed because the necessary paperwork had not been submitted by the defendants to the Department of Health and Human Resources 30 days, as is required by the West Virginia Medicaid coverage, according to the suit.
Saddler claims her Medicaid coverage expired six weeks following the date of delivery and she has had no medical insurance coverage since that date.
The defendants' negligence will cause Saddler to incur substantial medical expenses when she has the tubal ligation performed, according to the suit.
Saddler claims the defendants' actions have caused her capacity to enjoy life to substantially be reduced.
Saddler is seeking compensatory and punitive damages with pre- and post-judgment interest. She is representing himself.
The case has been assigned to Circuit Judge Tod J. Kaufman.
