CHARLESTON -- A former employee is suing Welding, Inc. after he claims the defendant failed to pay his final wages within 72 hours of terminating his employment.
Gary L. Summer was employed by the defendant from Sept. 21, 2005 until April 26, according to a complaint filed May 30 in Kanawha Circuit Court.
Summers claims the defendant failed to pay his final wages within 72 hours of discharge.
The defendant's actions violated the West Virginia Wage Payment and Collection Act, according to the suit.
Summers claims the defendant failed to pay his final wages until May 3.
Summers is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
