Big Rock Sports sues Outback Archery for failure to pay

HUNTINGTON -- Big Rock Sports, LLC is suing Outback Archery, Inc., after it claims the company has failed to pay more than $10,000 it owes.

On March 5, 2009, Outback Archery completed a dealer application for the purpose of obtaining credit from Big Rock Sports, according to a complaint filed May 23 in Cabell Circuit Court.

Big Rock claims the application was approved and credit was extended to the defendant.

Outback Archery received credit on account and the total balance due and owing as of Nov. 21, 2011, was $11,804.33, according to the suit.

Big Rock claims the defendant has failed to pay the sum on demand.

The defendant was provided with periodic account statements without dispute or response, according to the suit.

Big Rock is seeking damages in the amount of $11,804.33 with pre-judgment contractual interest at the rate of 18 percent per annum from Nov. 21, 2011 until the date of judgement. It is being represented by Daniel T. Booth.

The case has been assigned to Circuit Judge David M. Pancake.
