Cardiology fellow sues MU Board of Governors for unlawful termination

HUNTINGTON -- A Huntington cardiology fellow at Joan C. Edwards School of Medicine is suing the Marshall University Board of Governors after he claims it unlawfully terminated his clinical duties.

Ihtisham Choudhry has been employed as a cardiology fellow since July 1, 2010, according to a complaint filed June 7 in Cabell Circuit Court.

Choudhry claims his clinical duties have been unlawfully terminated under his employment contract and he has been informed that his contract will not be renewed.

The defendant's actions in terminating Choudhry's clinical duties were in breach of contract and discriminatory based on Choudhry's disability, race and religion, according to the suit.

Choudhry claims he suffers from depression, which has prevented him from passing his board examination, and that he is of Pakistani descent and is Muslin, both of which factored into the defendant's adverse employment actions.

Each of these factors was also used as unlawful reasons for the defendant's failure to renew Choudhry's contract for the third and final year of his fellowship program, according to the suit.

Choudhry is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Scott H. Kaminski.

The case has been assigned to Circuit Judge F. Jane Hustead.
