Tamara and Frank Hodges vs. St. Joseph's Hospital and West Virginia University Board of Governors

* After suffering a fall at her home, Tamara Hodges was taken to St. Joseph's Hospital, seen by Dr. Kim. Hodges and underwent surgery for a right elbow fracture. Hodges continued to experience pain, numbness and lack of range of motion. In the months following the surgery, she asked and was referred to WVU Hospital where another surgery was necessary to remove the hardware in her elbow from the initial surgery. She continued to experience pain and infection. Ultimately she sought another consultation with an orthopedic surgeon in Columbus, Ohio, who removed and replaced the elbow implant and placed her on intravenous antibiotic therapy. She is seeking judgment from St.Joseph's Hospital and WVU Board of Governors.

* Tate and Gutta, neighbors in East Gate Manor, allege after Big Sky Enterprises and CSL Holding purchased and developed property to build residential homes, their properties incurred a substantial increase in water runoff, causing their properties to become flooded. Tate and Gutta claim Potesta failed to properly design a plan to handle water runoff for the developed property. They seek compensatory damages, attorney fees and costs, punitive damages and a permanent injunction to prohibit the defendants from diverting water onto their properties.
