Woman sues Mardi Gras Casino & Resort for injuries

CHARLESTON -- A Cross Lanes woman is suing Racing Corporation of West Virginia after she fell on its property and sustained injuries.

Chapman-Martin Excavation & Grading, Inc.; Agsten Construction Company; and an unknown defendant were also named as defendants in the suit.

Racing Corporation of West Virginia is doing business as Mardi Gras Casino & Resort.

On June 15, 2010, Lori Raby was at Mardi Gras Casino & Resort when she fell and sustained injuries, according to a complaint filed June 12 in Kanawha Circuit Court.

Raby claims the defendants were negligent in allowing the unsafe and hazardous conditions to exist on its pathways and caused her injuries.

The defendants had a duty to maintain its walking surfaces in a reasonably safe and good condition and failed to do so, according to the suit.

Raby claims the defendants knew or should have know of the unsafe and hazardous conditions and should have fixed them.

The defendants' actions caused Raby to slip and fall and become severely injured, according to the suit.

Raby is seeking compensatory and punitive damages. She is being represented by Timothy A. Bradford.

The case has been assigned to Circuit Judge Louis H. Bloom.
