CHARLESTON -- A Raceland, Ky., couple is suing 42 companies they claim are responsible for a lung cancer diagnosis.
On July 20, 2011, Lawrence Edward Miller was diagnosed with lung cancer, according to a complaint filed June 27 in Kanawha Circuit Court.
Miller and his wife, Clara Faye Miller, claim the defendants exposed him to asbestos during his employment as a laborer and shipper from 1947 until 1993.
The defendants are being sued based on theories of negligence, contaminated buildings, breach of expressed/implied warrant, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.
The Millers are seeking a jury trial to resolve all issues involved. They are being represented by Bronwyn I. Rinehart, Victoria L. Antion and Scott A. McGee.
The case has been assigned to a visiting judge.
