CHARLESTON -- A Charleston woman is suing Par Mar after she was injured at its gas station.
On May 30, Linda Boggess was exiting the Par Mar gas station in St. Albans when she slipped on a floor mat and her right foot hit a broken hole in the cement sidewalk, which caused her to fall and sustain injuries, according to a complaint filed July 5 in Kanawha Circuit Court.
Boggess claims the defendant failed to maintain its premises in a reasonably safe condition; failed to exercise due care in maintenance and inspection; failed to adequately train its personnel in the appropriate methods to inspect and maintain the premises; failed to warn of hazards; failed to exercise due care; and other acts and omissions.
The defendant's negligence and carelessness caused Boggess to suffer injuries, some of which are permanent in nature, according to the suit.
Boggess claims the defendant also caused her to suffer mental anguish, emotional distress and a diminution in the ability to enjoy life.
Boggess is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Kathy A. Brown.
The case has been assigned to Circuit Judge Charles E. King.
